  1. The following are excerpts from dispatches which appear to involve personnel and may be of interest:

    "Following sent from BEE at 2045 'All ships in American convoy destroyed Stop all were anchored between Kaiyua wharf and Hohsien in midriver Stop PANAY attacked by bombers about 1324 she wa apparently hit and sinking bows first Meid Beached and abandoned on north shore stop after first bombing Meping and Meishan berthed alongside Kaiyuan wharf Hohsien stop fires extinguished and contract made with Japanese military who were standing alongside when ships were finally bombed and set on fire stop PANAY sailors now on board BEE were in Neipin at time of bombing remainder landed south shore vanes but believe trying to get Wuhu overland SOP Marshal James of colliers magazine was last seen last night walking inland badly wounded in neck Hodge JL fireman first class of PANAY missing'.

Acknowledgment is made of your letter of 21 D ecember 1937, in which you state that the Japanese Foreign Office has delivered a note to the American Embassy in Tokyo, in which it was stated that the Japanese Goverment "will make indefication for all the losses" sustained as a result of the bombing of the U.S.S. PANAY and American merchant vessels on December 12, 1937.

In connection with your request, the following estimate of the amount on account of damages sustained by the U.S.S. PANAY and equipment is submitted with the bases upon which the estimate is predicated:

The statement of equipage and supplies on hand, 30 September 1937, is based on official reports submitted as of the date mentioned. No subsequent returns have been received and it is considered proper to assume that little or no change in the value of supplies and equipage occurred udring the interim 1 October through the date on which the PANAY was lost.

The official account current submitted by tecial disbursing officer on board the PANAY for the quarter ending 30 September 1937, reported a cash balance on hand amounting to $2,808.94. No information is available at this time covering changes in this account since 30 September 1937.

The amount of the claims submitted for death and personal injury is the best estimate that the Judge Advocate General of the Navy could make with th elimited time available and considered precedents under somewhat similar state of facts. In all cases, and particularly in the cases of shock and exposure, the resultant damage incurred may not appear for some considerable time. in this connection, any settlement must considered the fact that the value of the dollar has depreciated since most of the claims considered for procedent have been adjudicated.

The claims submitted are based on a condition that the injuring state is prepared to pay the claims in a lump sum. If the claims are to be submitted to any board of arbitration, the amounts submitted herein should not be considered as final.

No account of damages for any civilians, State or War Department personnel and property or for damages punitive in nature, has been included.

MEMORANDUM FOR COMMANDER L. J. WILTSE, USN, Room 3914.

The following is a list of the personnel attached to the U.S.S. PANAY who were killed, seriously injured or slightly injured when that vessel was sunk by the Japanese near Hohsien, China on December 12th, 1937. This list shows the extent of the injuries sustained, as reported to this Bureau to date, and the dependents surviving those who died as result of the bombing.

No estimate can be made as to the cost of the several bills introduced for the adjudication on the World War basis, of death and disability claims resulting from the conditions in China, since the degree of disability is determined by the U.S.Veterans' Administration, and is the basis for all payments.

The Bureau decidedly favors World War rates instead of Peace Time rates in the adjudication of these claims.

With reference to these bills and similar legislation which may be introduced, your attention is invited to Veterans' Regulation 1-A, Part II, Par. 1-C, reading as follows:

"Any veteran or the dependents of any deceased veteran otherwise entitled to pension under the provisions of Part II of this regulation shall be entitled to receive the rate of pension provided in Part I of this regulation if the disability or death resulted from an injury received in line of duty in actual combat in a military expedition or military occupation."

It is suggested that the Secretary of the Navy be consulted towards the determination of whether or not service performed in China during the present crisis is described as a military expedition or occupation, in which case the necessity for private legislation may be obviated, and all casualties, past present and future can be adjudicated on World War basis under existing regulations.
