On Compliance by Mark "Bunny" Bundick, NAR President Many members have contacted me in the past three months striving to determine what things they must do in order to comply with Bureau of Alcohol, Tobacco and Firearms (BATF) regulations on high power rocket motors. This regulatory authority was invested in them by an act of Congress. The 1970's era legislation lists what are considered explosives and are quite explicit about what materials are to be regulated by BATF. The agency has little latitude in what it can and can't do regarding materials regulation, and large rocket motors fall into this category. Background: In early April, BATF representatives, including a staff attorney, attended a meeting of the National Fire Protection Association (NFPA) Sport Rocket Caucus in Huntsville, AL. They spent several hours discussing the current state of regulatory efforts in the HPR arena with NAR representatives. BATF field agents have received a memo from BATF Headquarters in Washington, DC notifying them to expect rocket folks to be applying for LEUP's. This memo directs field agents with question to Linda Deel at BATF HQ. Linda is familiar with the rocket issues and can answer likely questions from field agents. The memo also asks that there temporarily not be any enforcement actions regarding rocket use and storage. BATF agreed to work closely with members of the NFPA Sport Rocket Caucus, including the NAR, regarding a list of needs for HPR. The BATF will review our list and decide what can be supported and what cannot. BATF will also help us decide which items can be handled via interpretation, NPRM, and Congressional legislative change. A special committee of the Sport Rocket Caucus is drafting a letter for formal presentation to the BATF on these issues. The working group consists of: Randy Davidson, Chairman, NFPA Committee on Pyrotechnics Bruce Kelly, Tripoli Rocketry Association President Pat Miller, NAR NFPA Representative Mike Platt, HPMDA President A working document is due for review by the committee by June 1, and an August meeting to review the BATF responses and formulate the action plan. After those meetings, the NAR will continue its work with the Sport Rocket Caucus and the special committee to change either regulations or legislation. Current Regulations: The following items are considered exempt from BATF regulation: 1. black powder motors with less than or equal to 62.5 grams propellant, 2. Amonnium perchlorate (aka "composite" or "AP") single use motors of less than 80 Newton-seconds total impulse (i.e., F motors), which also contain less than or equal to 62.5 grams propellant. 3. AP reload modules where individual reload modules are less than 62.5 grams each, total propellant weight in the assembled motor less than or equal to 62.5 grams, and total impulse less than or equal to 80 Newton-seconds. If your flying activities are confined to these motors, you are completely exempt from any BATF storage or use regulations. All other motor usage requires you to obtain a Low Explosives Users Permit (LEUP) and comply with applicable storage regulations. In particular, the following conditions require a BATF Low Explosives Users Permit and proper explosives storage: 1. AP single use motors with more than 62.5 grams propellant; 2. AP reload modules which are equal to or more than 62.5 grams each; 3. AP reload modules which are less than 62.5 grams each but where the total assembled motor propellant weight is greater than or equal to 62.5 grams and total impulse of this assembled reloadable motor is more than 80 Newton seconds; 4. Thermalite igniters. This list clears lots of confusion, but several items still await BATF interpretation. At the Huntsville meeting, the BATF indicated we need to ask for clarification on the following items: 1. Black powder rocket motors with more than 62.5 grams propellant; 2. Model rocket igniters; 3. AP reload modules of less than 62.5 grams each where total assembled motor weight is greater than or equal to 62.5 grams; 4. AP reload modules greater than or equal to 62.5 grams each sold as a part of a reload kit. The process described in "Background" section clarifies the status of these items. How to Comply If your flying activities require an LEUP, you can obtain an application by sending a self addressed stamped envelope to: HPMDA c/o Mike Platt P.O. Box 404 Petersburg, NY 12138-0404 ATTN: LEUP Application You will receive a copy of ATF Form 5400.13/5400.16 to complete and file to obtain your permit. You must be 21 years old, be familiar with HPR motor storage regulations as evidenced by your application, and not have a felony criminal record. You can also expect a BATF representative to contact you directly after you apply. The original permit fee for a user is $20, and the permit, if granted will be good for three years. Then you will have to renew your permit. BATF will mail you a renewal application. The renewal permit fee is $10. Consumers can store up to 50 pounds of propellant weight of regulated materials in a Type 3 or 4 indoor magazine in an attached garage with one hour rated firewalls. These magazines are described in NFPA Code 495 "Explosives Materials Code." Indoor magazines must be painted red, and the top must bear the words "EXPLOSIVES -- KEEP FIRE AWAY" in white letters at least 3 inches (78 MM) high. There can be direct no in home storage. Summary: I realize these regulations, the permit process, and the surrounding confusion have caused many NAR members lots of frustration. However, I urge all affected NAR members to apply for their permits as soon as possible. If you have further questions particularly about the ongoing work with BATF, I urge you to contact Mike Platt as he is coordinating our efforts. I appreciate your patience and persistence, and I am hopeful that the Huntsville meeting will be a new beginning of regulatory cooperation that will sustain our growing numbers of HPR sport rocket flyers. Based on this, NAR S&T has investigated, contacting the manufacturer directly. We can report the following: MRC intends to stay in the model rocket business. Even if they ceased production today, they have enough motors in stock to supply rocketeers at current usage rates through the end of the calendar year, which is halfway into the next contest year. Therefore, MRC motors remain certified for contest and general use. Mark S. Johnson NAR #14025 Wichita, KS (Mid-America Region) Professionally, I am a software engineer for a computer peripheral and logic manufacturer. In my career, I have discovered that the ability to work with people is as important as the ability to work with things and ideas. I believe more than management ability goes into leadership. The best administrator can be rendered ineffective by his inability or unwillingness to treat his most important aspect - people - with respect for their ability. I began my involvement in rocketry since 1966. I helped found the KOSMO section, which has been in existence since 1980. I've always been involved in "grassroots rocketry." The NAR can, and should, grow into a larger and more vital organization. If this is to happen, I believe it must happen from the bottom up. Our committee chairs, Trustees, and officers need to be visible. We need to have a presence at local club meetings, local launches, and work with other organizations using rocketry in their programs. Recently, I assumed responsibility for the relaunch of the NAR's newsletter, The Model Rocketeer, which will provide much more timely information about the Association and the hobby to all its members. We will be able to make sure that all members have access to organizational news and other important information. As a Trustee, I would work toward finding something that we as an Association can offer to rocketeers that "you can't get anyplace else." I'm sure we can find one or several such services to offer. I ask you, the members, for the opportunity to help our Association to find its way to a future as an effective non-professional rocketry organization. Marc McReynolds NAR #11769 Fountain Valley, CA (Pacific Region) I have been an NAR member for 27 years. My interests include scale modeling, camera payloads and, more recently, radio-controlled gliders. I organized NARAM 29, participated in the 1988 Pink Book revision, and was a Scale judge at NARAMs 28, 34 and 36. Though some have called for confrontation, I believe it is imperative that we maintain positive relations with the federal agencies now scrutinizing our hobby. My son Joey is just starting out in model rocketry, and my most important job as a trustee is to make sure that it will still be around for him to enjoy with his children. Bob Alway NAR # 45556 Portage, MI (Mid-America Region) My involvement in model rocketry began in 1967 as a Jr. High student. I have had a long time special interest in aerial photography. As a founding member and former president of NAR section #500 SMASH (formerly WEMROC) I have participated in numerous activities. I taught model rocketry classes at the Kalamazoo Area activities. I taught model rocketry classes at the Kalamazoo Area Math and Science Center, taught 4-H model rocketry classes, gave talks on model rocketry for local organizations, was contest director of section and regional events, organized MASCON in 1992 and 1994, and participated at the rocketry display at the 'High on Kalamazoo' air show. At a national level, I have participated as Mid-America NAR contest chairman 1992-93. Made written response to proposed FAA regulations regarding mass restrictions on model rockets and aided others with their response. I have worked as a teacher from elementary through university levels and as a patent examiner with the United States Patent Trademark Office. I am currently employed as an Environmental Quality Analyst for the Michigan Department of Natural Resources where I work on the implementation of the Clean Air Act. I have greatly enjoyed my first one year term as an NAR trustee both as an education for myself and the contributions I have been able to make to model rocketry. I am running again as an NAR trustee because I want to continue supporting the association for benefits of its activities I have reaped over the years. George Gassaway NAR #18723 Homewood, AL (Southland Region) I have been involved in model rocketry and a member of the NAR since 1970. Have been involved in competition very much over the years, involving a number of national championships and four US Teams, but also do sport flying. Helped form two NAR sections in my area. Co-edited a newsletter for a few years, and have contributed articles and plans to other newsletters and the NAR's magazine. As an NAR volunteer, I was the Southland regional manager for a few years. For two years, ran the NAR season contest points database. Upon being elected to the Board last year, I was selected to be the NAR Secretary, and have been doing those duties ever since. Before being elected, two areas I expressed interest in improving were communication and competition. There now have been improvements in communications, with the implementation of the new Model Rocketeer newsletter, thanks in great part to the volunteers who help make it possible. Competition has not seen as much improvement yet, however. My interest in competition does not indicate a slight of sport rocketry, high power rocketry, or other areas of hobby rocketry. Those are also areas of interest to me personally. Everyone has their own levels of interest in different areas of the hobby which the NAR should serve to the best extent possible. Not the least, I would like input from other members for improvements and helping to solve existing problems. While not a manufacturer employee, I do have a link to two companies. I receive a small fee for helicopter recovery kits sold by North Coast Rocketry. Also produce at home a limited amount of resin cast glider pod hooks used by Apogee Components for their glider kits. 1995 National Association of Rocketry By-Laws Revision Proposals By-Laws proposal #1 Summary: Allow persons in any country to become an NAR member Change Article III (Membership) Section 1 (c) to read: " (c) citizens of other nations residing within or outside the United States." and strike Section 1 (d) and (e). Rationale: This removes a restriction on overseas membership previously imposed upon the Association by its franchise and association with the FAI, which is now null and void. By-Laws proposal #2 Summary: Manufacturers are not allowed to hold office as trustees. Add the following proposal to article VI, after section #1, as a new section #2. Should the proposal be adopted, renumber existing sections 2-13 as sections 3-14 to make room for the new section #2. "No employee of, or person with 10% or greater ownership of a manufacturer, dealer, or distributor of sport rockets or their components, consumer rocket motors or their components, or sport rocket launch equipment, shall be eligible for election or appointment to the Board of Trustees." Rationale: Prevents conflicts of interest between a consumer not-for-profit group, and manufacturing or marketing interests in areas of regulation, engine certification and standards setting. Strengthens the Association's reputation and position with government agencies, regulators and other standards setting bodies as an organization that represents consumers, as opposed to a trade group. NAR POLICY ON THE ELECTION OF MANUFACTURER REPRESENTATIVES TO THE BOARD OF TRUSTEES One of the major goals of the National Association of Rocketry is to establish standards for model rocket activities and equipment. A major part of the implementation of those standards is the testing and certification of model rocket engines. To be effective, the NAR must be impartial and maintain the trust of its members, the model rocket companies, and those other persons who look to the Association for guidance in the field of model rocketry. As part of maintaining that trust, we must minimize any influence a model rocket company or group of companies may have over the establishment or implementation of NAR standards. At the same time, it must be clear that the NAR wants to maintain a friendly and cooperative relationship with all model rocket companies and that there is no onus attached to a company employee openly exercising his NAR membership rights. To this end, the following policy is hereby established with respect to the membership of model rocket company employees on the NAR Board of Trustees and committees: 1. A model rocket company employee can be elected to the NAR Board of Trustees provided his relationship with the company is disclosed in all election literature sent to NAR members. Such disclosure must be made in a resume published in the Model Rocketeer prior to any Board of Trustee election voting. A person nominated from the floor of the meeting at which elections are held must make a verbal disclosure of any relationship with a model rocket company at the time he accepts the nomination. 2. A model rocket company employee cannot be appointed to the NAR Board of Trustees. The NAR President must make every effort to determine that an appointee to the Board is not an employee of a model rocket company. 3. A member of the NAR Board of Trustees who becomes employed by a model rocket company or receives a major increase in responsibility must resign from the Board unless nine (9) Trustees (not including the Trustee in question) vote to retain him. 4. If , at any time, the NAR President has evidence that a member of the Board of Trustees has not fully complied with the requirements stated in Sections 1 and/or 3 above, he must ask that member to refute the evidence. If the member fails to refute the evidence to the NAR President's satisfaction, he must ask for the member's resignation from the Board. If the member does not resign promptly, the NAR President must implement removal proceedings against that member as specified in the NAR By-Laws, Article VI, Section [10]. 5. A model rocket company employee cannot be appointed as chairman of an NAR standing committee unless ratified by three-quarters (3/4) of all NAR Trustees. The NAR President must make every effort to determine and disclose the relationship an appointee has with a model rocket company. 6. A model rocket company employee can be appointed to an NAR standing committee but must be ratified by the NAR President. 7. For purposes of implementing this policy, a model rocket company employee is a person who fits any of the following descriptions: a. A person who accepts a regular wage or salary from a model rocket company. b. A person who has greater than 15% ownership of a model rocket company. c. A person who accepts a retainer or regular fees for regular or irregular services to a model rocket company. This shall not include those whose only compensation is for writing technical manuscripts on an irregular basis. 8. For the purposes of implementing this policy, a model rocket company is a business organization existing for the purpose of making a profit through any of the following activities: a. Manufacture and sales of model rocket engines, kits, and/or parts. b. Publication of a commercial periodical on model rocketry. 9. A copy of this policy must be provided to every candidate for the NAR Board of Trustees and every NAR standing committee chairman nominee. 10. A copy or explanation of this policy must be published in the Model Rocketeer prior to each Board of Trustees election. 11. This policy becomes effective immediately upon passage by the NAR Board of Trustees. With respect to the Board of Trustees members in office at the time of passage, Section 3 applies only to employment or an increase in responsibility that occurs after the effective date of this policy. 12. This policy can be amended or rescinded only by agreement of three-quarters (3/4) of all the NAR Trustees. Included elsewhere in this newsletter are resumes by the candidates, description of the By-Law proposals, and self-mailer ballot for marking your choices and mailing them to the NAR Secretary for confidential tally. IMPORTANT - If you are a Senior, Leader, or Honorary member of the NAR at least 16 years of age at the time of your most recent renewal, and have been a member in good standing for at least one year as of July 24, 1995, you are eligible and encouraged to take part in the voting process. Changes this year - By-law amendments passed in February 1994 reduced the number of board seats from 13 to 9, therefore 9 board members were elected last year. The amendments also changed the election process such that 1/3 of the board (3 board seats) are elected every year, as opposed to the entire board every three years. Therefore this is the first of the now-annual election for three board seats. The seats up for election this year are those won by the three board members who received the three lowest vote totals in the 1994 election. Instructions: - Vote for no more than three candidates. You may vote for fewer, if you desire. Be sure to specify your region on the ballot. The ballot may NOT be copied. - Use only the original ballot (self-mailer) contained in this newsletter. NAR Headquarters will provide additional ballots for family plan members who need extras. Trustee elections are conducted using secret ballots. A self-mailer designed for this purpose is enclosed. - You must provide your full name, address, NAR number, and date of birth where directed on the mailer, and only there. We must have this information to ensure that your ballot is valid. Then mark your votes on the ballot section, fold, and tape the mailer as directed, stamp, and mail. Please do not remove your white address label from the back side of the folding ballot. Fold the ballot so your label is on the inside. After your self-mailer has been verified from the information provided on the outside (voter ID info), your ballot will be detached and deposited, unopened, into a ballot box for later confidential tally. - Deadline for receiving ballots is Friday July 14, 1995. Voters are encouraged to fill out and mail in their ballots promptly so as to arrive well ahead of the deadline. Regional Representation - According to Article VI of the NAR By-Laws, the Board must include at least one member of the six geographical regions, but no more than three for any single region. The states comprising each region are identified on the enclosed ballot. If the final tally leaves any region without at least one representative on the Board, the candidate placing last will be dropped and replaced with a representative from that region, as decided solely by the votes cast by that region. For this reason, it is important for you to indicate on the ballot which region you reside in. Manufacturers as Trustees - As required by an NAR policy adopted in 1972, a copy of that policy is included in this mailing. This policy sets limitations and disclosure requirements on owners or employees of rocket companies who seek to run for the NAR Board of Trustees. Attending the Association Meeting - Eligible voters may vote by mail ballot or in person at the Association meeting at NARAM-37 in Geneseo, NY. The meeting will be held Monday night, July 24, after the NAR "Town Hall" meeting which will begin at 7:30 PM. Additional board nominations may be made form the floor of the Association Meeting. These may include mailed-in ("write-in") nominations that do not appear on the ballot. For this reason, if you plan to attend the Association meeting in person, do not mail in this ballot. The Tally committee will not be able to identify and destroy your original ballot at the meeting. Distinct blank ballots will be used for the votes cast at the Association Meeting.
